Anayer Terms and Conditions

These terms and conditions (“T&Cs”) govern your access to and use of the Application (as defined below). The Application is operated by Anayer Technologies Inc. and its subsidiaries, associates, licensees, and affiliated companies (“Anayer”). By using the Application, you agree to these T&Cs.
Please read and understand these T&Cs carefully before using the Application and its features. If you do not agree to these T&Cs, you must not access or use the Application or its features. Your acceptance of these T&Cs constitutes a binding and legally enforceable agreement between you and Anayer Technologies Inc. regarding the use of the Application.
1. Definitions
- Account: Refers to the User’s account on the Application, enabling access to the Features and Services provided by Anayer Technologies Inc.
- Application: Refers to the mobile application “Anayer,” including any updates, upgrades, or enhancements provided by Anayer Technologies Inc. from time to time.
- Features: Refers to the functionalities, tools, and services made available through the Applications.
- Registration Data: Refers to accurate and current information provided by the User during registration on the Application, including but not limited to name, email address, age, and other details requested by Anayer Technologies Inc.
- Services: Refers to any offerings, tools, or functionalities provided by Anayer Technologies Inc. via the Application.
- User: Refers to any individual who has created an Account and uses the Application.
- You,” “Your,” or “Yourself: Refers to the User accessing the Application.
- Rider/Passenger/Customers: Refers to a person requesting transportation services or any other service using the Anayer Platform.
- Driver/Partner: (Also referred to as “you”) Refers to the person providing transportation services via the Anayer Platform. Each Driver will receive a personal Anayer Driver Account to use the Anayer App and Anayer Platform.
- Anayer Fee
The fee that the Driver is required to pay to Anayer for accessing and using the Anayer Platform. - In-app Payment
Refers to payment methods such as cards, carrier billing, and other options utilized by the Passenger through the Anayer App to pay for Transportation Services. - Transportation Services
The transportation service provided by the Driver to the Passenger in response to a request accepted by the Driver through the Anayer App. - Support Agent
An Anayer operations representative responsible for providing technical support services, facilitating payments, and managing invoicing on behalf of Anayer. Support Agents may also handle complaints, resolve disputes related to payments, and address technical issues for Anayer.
2.1. Registration Process
Before using the Anayer Services, you must complete the sign-up process by providing the requested information on the registration application available on our website, including uploading any necessary documentation as required by us. You may register as a Rider, Driver, or Vendor. Upon successful registration, we will provide you with a personal account accessible via a username and password. By selecting the "Sign up" button at the end of the registration process, you represent and warrant that:
- You are legally authorized to enter into an agreement with us to use the Anayer Platform for providing the relevant services (Transportation Services for Drivers, or other services for Vendors).
- You have fully reviewed, understand, and agree to be bound by these General Terms, including all obligations outlined herein and within the Agreement.
- The information you have provided is complete, accurate, and correct.
- You will ensure that your Anayer account (Rider, Driver, or Vendor) and profile information remain up-to-date at all times.
- You will not allow others to use your Anayer account or transfer it to any other individual.
- You will not use the Anayer Services for unauthorized or illegal purposes or in any manner that could impair the proper operation of the Anayer Services.
- You will comply with all applicable laws and regulations in the jurisdiction where you provide services, including regulations governing passenger transportation or any other relevant laws for Vendors.
2.2. Bank Account Details
During the registration process, you are required to provide your bank account information for payment purposes. If you are registering as a legal entity, you must provide the bank account details of the company. Anayer will transfer the In-app Payment fees to the provided bank account. We are not responsible for any incorrect transactions resulting from inaccurate bank account details.
2.3. Additional Requirements for Registration
After submitting your registration, you will receive an email outlining any additional conditions that must be met to use Anayer Services. These may include providing criminal records, a valid driving license, proof of the vehicle’s satisfactory technical condition, completion of training, owning a GPS-enabled mobile device, or other conditions specified in the email. Failure to meet these requirements may result in termination of the Agreement and your access to the Anayer Services.
2.4. Assignment of Obligations
In certain cities or countries, Anayer may assign specific obligations arising from the General Terms or the Agreement to Anayer group companies or partners. These obligations may include reviewing documents related to registration applications, conducting training, collecting Anayer Fees, mediating In-app Payments, licensing the Anayer App, and other related tasks. Details of the Anayer group companies and partners can be found at Anayer Cities.
2.5. Vendor Account
If you are registering as a vendor, you must provide all necessary business details, including but not limited to your company name, tax identification number, and a valid business address. Vendors are responsible for ensuring that the services they provide through the Anayer Platform meet all applicable legal and regulatory requirements. By registering as a vendor, you agree to these terms and understand that any violation of the General Terms or Agreement will result in the suspension or termination of your account. Vendors are also responsible for the accuracy of the information provided during the sign-up process and must ensure that it remains up-to-date.
2.6. Driver Account
If you are registering as a Driver, you must provide the following details:
- Personal Information: Full name, email address, phone number, and a valid government-issued identification number.
- Vehicle Information: Make, model, year, color, license plate number, and proof of the vehicle’s insurance and inspection.
- Driving License: A valid driving license applicable in the jurisdiction where you plan to provide services.
- Background Check: Consent to a criminal background check (as required by local laws or Anayer policies).
- Bank Account Information: You must provide a bank account where the payments for your services will be deposited.
By registering as a Driver, you represent and warrant that:
- You are legally authorized to provide Transportation Services in your jurisdiction.
- Your vehicle meets all safety and regulatory requirements as applicable in your jurisdiction.
- You will adhere to Anayer’s operational guidelines, including maintaining the vehicle’s condition and complying with all traffic and safety regulations.
- You will ensure your profile and account details remain up-to-date.
- Failure to provide accurate information or meet these requirements may result in the termination of your Driver Account.
2.7. Registering as a Legal Entity
You are considered a legal entity if the recipient of the fees in the payment details (as accessible through the Anayer account) is marked as such. In this case, the legal entity is deemed to be the provider of services (Transportation or other services) and a party to these General Terms and Agreement. The natural person listed during the sign-up process may provide the services on behalf of the legal entity, but only after acknowledging and agreeing to these General Terms and any further documents that are part of the Agreement. Both the legal entity and the natural person providing the services will be jointly and severally liable for any breach of the General Terms and Agreement.
2.8. Fleet Company Registration
A fleet company may register accounts for its employees or service providers under a separate agreement. The fleet company is responsible for ensuring that its employees or service providers comply with the General Terms, Agreement, and any other related agreements. The fleet company and its employees or service providers will be jointly and severally liable for any violations committed by them.
3. RIGHT TO USE Anayer APP, Anayer DRIVER ACCOUNT, AND Anayer VENDOR ACCOUNT
3.1. License to Use the Anayer App, Driver Account, and Vendor Account
We grant you a limited, non-exclusive, and non-transferable license to access and use the Anayer App, Anayer Driver Account, and Anayer Vendor Account. This license allows you to use the Anayer App and your respective account solely for the purpose of providing transportation services (for Drivers) or other services (for Vendors) via the Anayer platform. You may not sublicense, transfer, or otherwise assign the rights to any third party.
However, fleet companies may sublicense the Anayer App and Driver Account to their employees or fleet members, subject to separate agreements with Anayer. Similarly, vendors may provide their services to customers through their Vendor Account in compliance with Anayer’s terms and policies.
3.2. Restrictions on the Use of the Anayer App, Driver Account, and Vendor Account
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Anayer App, Driver Account, Vendor Account, or any other software provided by Anayer.
- Modify, adapt, or create derivative works based on the Anayer App, Driver Account, or Vendor Account, or use any modified versions of these services.
- Upload, transmit, or distribute files that contain viruses, corrupted data, or any other malicious software that may damage or disrupt the Anayer platform.
- Attempt to gain unauthorized access to the Anayer App, Driver Account, Vendor Account, or any other part of the Anayer Services, including attempting to bypass any security features of the platform.
3.3. Termination of License
The license granted under this Agreement will automatically terminate upon the termination of the Agreement. Upon termination, you must immediately stop using the Anayer App, Driver Account, and/or Vendor Account. Anayer reserves the right to block or delete your Driver Account or Vendor Account without prior notice.
3.4. Use of Anayer Tags and Labels
Anayer may provide you with branding materials such as tags, labels, stickers, or other identifiers that reference the Anayer brand or indicate that you are using the Anayer Platform. You are granted a non-exclusive, non-sublicensable, and non-transferable license to use these items solely for the purpose of indicating that you are providing transportation services (for Drivers) or other services (for Vendors) through the Anayer platform.
Upon termination of this Agreement, you must immediately remove and dispose of any Anayer branding materials.
3.5. Ownership of Intellectual Property
All intellectual property rights, including but not limited to copyrights, trademarks, source code, databases, logos, and visual designs, are owned by Anayer and protected under copyright, trademark, and trade secret laws, as well as applicable international treaties. By using the Anayer App, Driver Account, or Vendor Account, you acknowledge that you do not acquire any ownership rights in Anayer’s intellectual property.
4. PROVIDING THE TRANSPORTATION AND DELIVERY SERVICES
4.1. The Driver's and Vendor's Obligations: You hereby guarantee to provide the Transportation Services or Delivery Services in accordance with the General Terms, Agreement, as well as all applicable laws and regulations in the jurisdiction where you are providing the services. You are fully liable for any violations of local laws or regulations that may arise from providing the services, whether transportation or delivery-related.
4.2. Required Licenses and Documentation: To provide the Transportation or Delivery Services, you must maintain all necessary licenses (including a valid driver's license for Drivers), permits, insurance (including vehicle and liability insurance), vehicle registrations, certifications, and other documentation required by the applicable jurisdiction. You are responsible for ensuring the validity of these documents at all times. Anayer reserves the right to request evidence of these licenses, permits, and certifications for review.
4.3. Professional Conduct in Providing Services: You must provide the Transportation or Delivery Services in a professional manner, adhering to the ethical standards applicable to such services. For Drivers, this includes:
- Taking the most economical route for the Passenger unless otherwise requested.
- Refraining from making unauthorized stops.
- Ensuring no passengers other than the Passenger and their companions are in the vehicle.
- Adhering to all traffic laws and regulations, including not holding a phone while driving.
For Vendors, similar professional conduct applies, ensuring timely and safe deliveries.
4.4. Your Right to Accept or Decline Service Requests: You have the sole discretion to accept, decline, or ignore service requests made by Passengers (for transportation) or Customers (for deliveries). There is no obligation to accept any particular request.
4.5. Costs Incurred While Providing Services: You are responsible for providing and maintaining all necessary equipment to perform the services, such as a vehicle, smartphone, etc., at your own expense. Additionally, you will bear all associated costs, including but not limited to fuel, mobile data plan costs, vehicle amortization, insurance, taxes, and any other expenses required for providing the services. We suggest opting for a data plan with high or unlimited usage, as using the Anayer App may consume significant data.
4.6. Fares for Transportation or Delivery Services: You are entitled to charge a fare for each completed service (either transportation or delivery). The Fare is calculated based on the base fare, the distance of the journey (for transportation) or delivery distance, and the duration (for transportation). The Fare may vary depending on market conditions. You may request a fare adjustment via Anayer if needed. You can also choose to charge less than the fare displayed in the App, but this does not reduce the Anayer Fee.
4.7. Upfront Fare for Transportation Services: For transportation services, a Passenger may be offered an upfront fare that is agreed upon before the ride is requested. If the Passenger changes the destination or if unexpected circumstances affect the ride, the Fare calculated based on the actual service will be applied instead of the upfront fare.
4.8. Fare Discrepancies: If you believe there has been an error in the fare calculation, you must submit a request via the "Anayer Support" section in the Anayer App. Anayer will not recalculate the fare or reimburse you for errors unless a petition is submitted in the app.
4.9. Fare Adjustments by Anayer: Anayer may adjust the Fare if we detect violations such as taking a longer route or failure to end the fare meter at the appropriate time. We may also adjust the fare if technical errors are identified, or if there are valid suspicions of fraud or complaints from Passengers.
4.10. Payment of Fare: Passengers or Customers may pay the fare for services either directly to you or via the in-app payment system, as described in section 6. If the fare is paid directly, you are responsible for collecting the payment. If the Passenger or Customer refuses to pay, Anayer will act on your behalf to collect the payment. However, Anayer is not liable for unpaid fares. If the payment is refused due to inaccurate details in the Anayer App, Anayer will not reimburse you.
4.11. Receipts for Completed Services: After completing a service, Anayer will generate and forward a receipt to the Passenger or Customer, containing essential details such as business name, service details, driver’s or vendor's name, vehicle or delivery details, fare breakdown, and payment information. These receipts are also available to you via your Anayer account.
4.12. Cancellation and Wait Time Fees: If a Passenger cancels a service request after a certain time, you are entitled to a cancellation fee. Similarly, if there are delays in the service, wait time fees may apply.
4.13. Damage by Passenger or Customer: If a Passenger or Customer damages the vehicle or goods being delivered, you have the right to request compensation. This may include penalties or the actual cost of damages. If the Passenger or Customer refuses to pay, Anayer will attempt to recover the amount on your behalf, though we are not liable for cleaning or maintenance costs.
4.14. Tax Obligations: You are fully responsible for complying with all applicable tax obligations related to providing the services. This includes paying income taxes, social security taxes, and any other applicable taxes. You must also ensure proper tax registration and reporting to relevant authorities. Anayer may provide information about your activities to tax authorities as required by law. You agree to compensate Anayer for any fines, claims, or fees resulting from your failure to comply with tax regulations.
4.15. Anayer's Right to Issue Invoices: Anayer has the right to issue invoices on your behalf to Passengers or Customers for the services provided. These invoices will be available to you via your Anayer account.
5. ANAYER FEES
5.1. In order to use the Anayer Services, you are obliged to pay a fee (i.e., the Anayer Fee). The Anayer Fee is paid based on the Fare of each Transportation Service order that you have completed. The amount of the Anayer Fee is made available to you via e-mail, the Anayer App, your Anayer Driver Account, or other pertinent means. Please acknowledge that the Anayer Fee may change from time to time. We shall send you prior notification of each such change.
5.2. You must pay the Anayer Fee and any other fees due to us for the previous month at the latest by the 15th date of the following month. Upon delay with payment of the Anayer Fee, you shall be obliged to pay a penalty of late payment in the amount of 0.04% (zero point zero four percent) of the unpaid amount per day. You are obliged to cover all costs incurred by us, which are related to debt collection activities.
6. IN-APP PAYMENTS
6.1. We may enable Passengers to pay for the Transportation Service via cards, carrier billing, and other payment methods (Anayer Business, etc.) directly in the Anayer App (i.e., In-app Payment). You hereby authorise us to act as your limited commercial agent solely for the purpose of collecting, on your behalf, the Fares or other fees paid by the Passenger via In-app Payment. Any payment obligation made by the Passenger via the In-app Payment shall be considered fulfilled as of the time that the payment has been made.
6.2. You may not refuse payment by the Passenger via the In-app Payment or influence the Passenger against the use of the In-app Payment. In case you refuse to accept an In-app Payment without just cause, we shall be entitled to charge you a contractual penalty fine for every refusal and/or block your right to use the Anayer Services in case of repetitive behaviour.
6.3. Anayer reserves the right to distribute promo codes to riders at our discretion on a per promotional basis. You are required to accept the use of promo codes only when the rider applies the code in-app to a trip using card payment.
6.4. You are entitled to review In-app Payment reports in the Anayer Driver Account or App. The reports will show the amounts of the In-app Payments brokered in the previous week as well as the withheld amounts of the Anayer Fee. You must notify us of any important circumstances which may affect our obligations to collect and distribute the Fares paid via In-app Payment.
6.5. We are not obliged to pay you the Fare due from the Passenger if the In-app Payment failed because the Passenger's credit card or other payment is cancelled or unsuccessful for other reasons. In such case, we will help you in requesting the Fare due from the Passenger and shall transmit it to you once the Passenger has made the requested payment.
6.6. Before providing Transportation Services, you must verify that the service is being provided to the right Passenger or that the Passenger has expressly confirmed they allow other passengers to ride under the Passenger's account. If you make a mistake in identifying the Passenger, and the In-app Payment is charged to a person who has not been provided or has not approved the Transportation Services for other passengers, then we shall reimburse the person for the Fare. In such case, you are not entitled to receive the Fare from us. Additionally, for every wrongfully applied In-app Payment, we shall be entitled to charge you a contractual penalty of up to 10 Euros.
6.7. Please note that we will set off any Fares paid via In-app Payment against the amounts that you are obliged to pay to us (i.e., Anayer Fees and contractual penalties). We reserve the right to fulfil any of your financial liabilities to any Anayer group companies, in which case we will acquire the right to submit a claim against you. We may set off any of your financial liabilities against financial liabilities that you may have against us.
6.8. If we are not able to pay the Fees to you due to you not including your bank account details in your Driver's account or if the bank account details have been noted incorrectly, then we will hold such payments for 180 days. If you do not notify us of the correct bank account details within 180 days from the date that the right to claim such payments has been established, your claim regarding the payment of the Fare not transferred to you shall expire.
7. CUSTOMER SUPPORT
We provide the Drivers customer support regarding the use of the Anayer Services. We have the right to stop providing the customer support services in case you are in delay with any of the payments for more than 5 (five) calendar days.
8. RATINGS AND ACTIVITY
8.1. In order to guarantee high-quality service and provide additional reassurance to Passengers, you hereby acknowledge that the Passengers may provide you a rating and leave feedback regarding the quality of the services (whether transportation or vendor-related) that you have provided. Your average rating will be linked to your Driver or Vendor account and will be available to Passengers via the Anayer App. If we find out the rating or comment is not given in good faith, this rating or comment may not be projected in the calculations of your rating.
8.2. In addition to the rating, we measure your level of activity and provide you with an activity score, which is based on your activity regarding accepting, declining, not responding, and completing service requests (for both Transportation Services and Vendor Services).
8.3. In order to provide reliable services to Passengers, we may determine a minimum average rating and a minimum activity score that Drivers and Vendors must establish and maintain. If, after a pertinent notification from us, you do not increase your average rating or activity score to the minimum level within the prescribed time period, your Driver or Vendor account will be automatically suspended either temporarily or permanently. We may reverse the suspension of your account if it is merited by any external circumstances or it is detected that the suspension was caused by a system error or false ratings.
9. MARKET OVERVIEWS AND CAMPAIGNS
9.1. Market overviews. We may send you, via the Anayer App, Anayer Driver/Vendor Account, SMS, email, or other means, market overviews, in order to increase your awareness regarding when the demand by the Passengers is highest. Such market overviews are merely recommendatory and do not constitute any obligations for you. As the market overview estimations are based on previous statistics, we cannot give any guarantees that the actual market situation will correspond to the estimations provided in the market overview.
9.2. Campaigns promising minimum income. We may also provide campaigns, whereby we will guarantee a minimum income if you provide Transportation Services or Vendor Services within a specified timeframe. If the specified minimum is not reached by you, we shall compensate the gap. The specific requirements and conditions will be sent via the Anayer App, Anayer Driver/Vendor Account, SMS, email, or other means. We have full discretion in deciding if, when, and to which Drivers or Vendors we provide such campaigns. If we have reasonable cause to suspect any fraudulent activity by you, we may withhold your Fare or Vendor payment until the suspicion of fraud has been cleared.
9.3. Campaigns for Passengers. We may also occasionally arrange various campaigns to Passengers in order to promote the Anayer Platform. If the Fare paid by the Passengers is reduced as part of such campaign, we shall pay you compensation, amounting to the monetary value of the benefit offered to the Passengers. We may set off the marketing compensation against the Anayer Fee.
10. RELATIONSHIP BETWEEN YOU, US, AND THE PASSENGERS
10.1. You hereby acknowledge and agree that we provide an information society service and do not provide Transportation Services or Vendor Services. By providing the Anayer Platform and Anayer Services, we act as a marketplace connecting Passengers with Drivers and Vendors to help them move around cities more efficiently or purchase services and products. You acknowledge that you are providing the Transportation Services or Vendor Services on the basis of a contract for the carriage of passengers or provision of services and that you provide the services either independently or via a company as an economic and professional activity.
10.2. You acknowledge that no employment agreement nor an employment relationship has been or will be established between you and us. You also acknowledge that no joint venture or partnership exists between you and us. You may not act as an employee, agent, or representative of us nor bind any contract on behalf of us. If due to the implication of mandatory laws or otherwise, you shall be deemed an employee of us, you hereby agree to waive any claims against us that may arise as a result of such implied employment relationship.
10.3. You may not transfer your rights and obligations deriving from the General Terms or Agreement to any third party.
11. PROCESSING OF PERSONAL DATA
Your personal data will be processed in accordance with the Privacy Notice, available at Anayer Policy
12. LIABILITY
12.1. The Anayer Platform is provided on an "as is" and "as available" basis. We do not represent, warrant, or guarantee that access to Anayer Platform will be uninterrupted or error-free. As the usage of Anayer Platform for requesting transportation or vendor services depends on the behavior of Passengers, we do not guarantee that your usage of the Anayer Platform will result in any service requests.
12.2. To the maximum extent permitted under the applicable law, we, nor Anayer's representatives, directors, and employees are not liable for any loss or damage that you may incur as a result of using the Anayer Services, including but not limited to:
- Any direct or indirect property damage or monetary loss;
- Loss of profit or anticipated savings;
- Loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business;
- Loss or inaccuracy of data;
- Any other type of loss or damage.
12.3. The financial liability of us in connection with violating the General Terms or Agreement will be limited to a fine of 500 Euros. You shall have the right to claim for damages only if we have deliberately violated the General Terms or Agreement.
12.4. We shall not be liable for the actions or non-actions of the Passenger or co-passengers and shall not be liable for any loss or damage that may incur to you or your vehicle as a result of actions or non-actions of the Passenger or co-passengers.
12.5. You shall be fully liable for breach of the General Terms, Agreement, or any other applicable laws or regulations and must stop and remedy such breach immediately after receipt of a respective demand from us or any state authority. You shall indemnify us for any direct and/or indirect loss and/or damage, loss of profits, expense, penalty, fine that we may incur in connection with your breach of the General Terms, Agreement, and laws and regulations. If Passenger presents any claims against us in connection with your provision of Transportation Services or Vendor Services, then you shall compensate such damage to us in full within 7 (seven) days as of your receipt of the respective request from us.
13. TERM AND TERMINATION
13.1. The conditions expressly specified in these General Terms shall enter into force as of submitting the signup application. Agreements and other terms shall enter into force once the specific document or message has been made available to you and you commence or continue providing Transportation Services or Vendor Services on the Anayer Platform.
13.2. You may terminate the Agreement at any time by notifying Anayer at least 7 (seven) days in advance, after which your right to use the Anayer Platform and Anayer Services shall terminate. Anayer may terminate the Agreement at any time and for any reason at the sole discretion of us by notifying you at least 3 (three) days in advance.
13.3. Anayer is entitled to immediately terminate the Agreement and block your access to Anayer Platform without giving any advance notice in case you breach the General Terms or Agreement, any applicable laws or regulations, disparage Anayer, or cause harm to Anayer's brand, reputation, or business as determined by Anayer in our sole discretion. In the aforementioned cases, we may, at our own discretion, prohibit you from registering a new Driver or Vendor account.
13.4. We may also immediately block your access to the Anayer Platform and to the Anayer Driver or Vendor Account for the period of investigation, if we suspect an infringement of the Agreement or fraudulent activity from your behalf. The block of access will be removed once the investigation disproves such suspicions.
13.5. We are aiming to provide the highest quality service to all Passengers and Vendors; therefore, we are monitoring the activity of Drivers and Vendors on Anayer Platform. If you fail to meet the minimal service requirements, such as the minimal rating and activity score, we are entitled to immediately terminate the Agreement without giving any advance notice.
14. AMENDMENTS
14.1. Any changes to the Agreement shall enter into force after they have been made available to you via e-mail, Anayer App, or Anayer Driver/Vendor Account and you have continued to provide the Transportation Services or Vendor Services.
15. APPLICABLE LAW AND COURT JURISDICTION
15.1. These General Terms and Agreement shall be governed by and construed in accordance with the applicable laws of the country in which you are providing services. In the event of a dispute that cannot be settled through negotiations, such dispute shall be resolved in a court of competent jurisdiction within the country of operation, where the service is provided. We may, at our sole discretion, determine the location for dispute resolution.
16. NOTICES
16.1. You are obligated to immediately notify us of any changes to your contact information, including, but not limited to, email address, phone number, and other relevant details associated with your Anayer profile.
16.2. Any notice required to be given under these General Terms and Agreement shall be sufficiently given if:
- (i) delivered personally,
- (ii) sent by courier with proof of delivery,
- (iii) sent by registered mail,
- (iv) sent by e-mail, or
- (v) made available via the Anayer App or Anayer Driver/Vendor Account.
Any notice sent in accordance with this clause shall be deemed to have been received:
- (i) if delivered personally, at the time of delivery;
- (ii) if delivered by courier, on the date stated by the courier as the date of delivery;
- (iii) if sent by registered mail, on the 10th day after handing the document to the post office;
- (iv) if made available via the Anayer App or Anayer Driver/Vendor Account, or
- (v) if sent by e-mail, on the day the recipient confirms receipt of the email or on the second day after the email was sent, provided that no error notification is received and the email was resent in case of failure.
17. REGISTRATION REQUIREMENTS FOR DRIVERS AND VENDORS
17.1. Before activation, drivers and vendors must meet the following registration requirements:
- Upload up-to-date personal identification and relevant licenses that match the details submitted to our system.
- Upload an up-to-date vehicle insurance document (for drivers) or business documents (for vendors) that match the vehicle or business details uploaded to our system.
- Upload a clear professional profile picture on your Anayer profile page.
17.2. Equipment Quality Policy (For Drivers)
Minimum vehicle requirements:
- Vehicle must be no older than 15 years.
- The vehicle must have 4 doors.
- The vehicle must be in good condition, with no cosmetic damage.
- No commercial branding on the vehicle.
- The vehicle must pass the relevant local road safety inspection.
Cosmetic guidelines for vehicles:
- Full-body wraps containing advertisements or large ads are prohibited.
- Holes in the exterior, significant damage to the interior (e.g., torn seats or stains), and excessive paint oxidation are not allowed.
- Aftermarket modifications that do not meet the minimum safety standards are prohibited.
- Window tinting must comply with local regulations.
All drivers must maintain insurance policies in accordance with the relevant state or local laws.
17.3. Vendor Quality Policy
As an e-commerce vendor on the Anayer platform, you are required to adhere to the following quality standards to ensure that your products and services meet the expectations of customers:
- Product Quality: All products sold through the Anayer platform must meet relevant safety and quality standards and be described accurately in terms of size, color, and specifications. Products should not be expired, damaged, or in any way defective unless explicitly stated.
- Packaging: Products must be packaged securely to prevent damage during transit. Packaging should be professional and free from any form of advertising unrelated to the product itself.
- Customer Service: Vendors are expected to respond to customer queries and resolve issues promptly. Any product complaints should be handled in a timely manner, and vendors must offer reasonable return or refund policies as per local laws.
- Timely Fulfillment: Orders should be processed and shipped in accordance with the timelines agreed upon at the point of sale. Delays without prior communication to the customer may result in penalties.
- Compliance with Laws: Vendors must comply with all applicable local, regional, and national regulations, including but not limited to product safety, fair trade, and data protection laws.
Failure to adhere to these standards may lead to account suspension or removal from the Anayer platform.

18. SIGN-UP AND LOYALTY BONUS WITHDRAWAL REQUIREMENTS
To qualify for withdrawal of sign-up and loyalty bonuses, drivers and vendors must meet the following requirements after registration:
- Stay active for at least 8 hours a day, five days a week, between 6:00 AM and 8:00 PM.
- Successfully complete a minimum of three (3) trips (rides/deliveries) after registration.
- Earn a minimum total fare of a specified amount (or equivalent) from completed trips (rides/deliveries).
19. FINAL PROVISIONS
If any provision of these General Terms is found to be unenforceable, the parties will replace it with an enforceable provision that approximates the original intent and economic effect of the unenforceable provision.
